Former fashion mogul Peter Nygard is appealing a court decision that denied him bail while he challenges his sexual assault convictions and sentence.
Nygard’s legal team is scheduled to appear before the Ontario Court of Appeal today, arguing that the motions judge erred in dismissing his bail application last month.
In their written submissions, Nygard’s lawyers contend that the judge "unfairly discounted" the significance of a new medical report submitted as part of the bail request.
The motions judge previously stated that Nygard's appeal appeared to be "weak" and that he poses a flight risk, particularly since he faces additional charges in other jurisdictions.
Appeal Court Justice Lene Madsen commented on the new medical report, noting that it relied heavily on self-reported information and that Nygard's health needs were already considered during the sentencing phase.
Last year, Nygard was found guilty on four counts of sexual assault, with allegations stemming from incidents that occurred between the 1980s and the mid-2000s.
